GD Item 3 We are very disappointed that only limited NGOs have the opportunity to take part in the interactive dialogues with the special Rapporteurs, the representatives of working groups, and the independent experts in the council sessions. As an NGO, Sudwind has a special interest in the right to possess a clean environment. We are pleased that the agenda of this session included the first report of the Independent Expert on Environment. We would also like to bring attention to the council of dried wetlands and both sweet and salty lakes, over all due to the wrong policies of instructing dams on their water resources. This has caused dust, sand and salt storms in Iran. We urge all countries to implement their commitments especially to the Article 14 of ICCPR. “All persons shall be equal before the courts and tribunals and everyone shall be entitled to a fair and public hearing by a competent, independent and impartial tribunal established by law”. The report of the Working group on arbitrary arrests mentioned the arbitrary house arrest of Mrs. Zahra Rahnavard, Mr Mousavi and Mr Karubi the two candidates of the disputed election of June 2009 and the arbitrary arrest of Mr Abdollfatah Soltani and Mohammad Sadigh Kaboudvand. In June 2013. the people of Iran are looking forward to the new presidential election. Since the very first election after the 1979 revolution, a free and fair election right has been taken away from Iranians. However, in some elections it has been permitted to compete to a certain extent. With imprisonment of Mr Mousavi and Karoubi, in absent of freedom of political parties, the possibility of holding election meetings and freedom of press, especially with the arrest of independent journalists in the recent weeks, the competitive election is greatly limited. In article 7 of ICCPR it is obviously sited: “No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment. Means no amputation as judiciary sentence, no torture in prisons.” There is no excuse about death of prisoners under torture or any other kind of ill treatment. The very sad examples are Mr Satter Beheshti or Mr Hoda Saber. The States must oblige their commitments
